- BUI cases are usually prosecuted by the Delaware Division of Natural Resources and Environmental Control (DNREC).
- DNREC organizes DUI checkpoints on the water, just like the State Police do on the roadways (google “operation dry water” sometime and check it out).
- The Boating Under the Influence laws are found at Title 23, Chapter 23 of the Delaware Code.
- The blood alcohol limit for boating is the same as for alcohol — .08.
- The penalties differ from regular DUI. A first offense BUI conviction carries a prison sentence of sixty days to six months, and a fine of $200 to $1000. A second BUI conviction within five years of the first carries a jail term of a mandatory minimum of 60 days up to eighteen months, and a fine of $500 to $2,000. A third offense BUI is a felony.
